उच्चतम न्यायालय ने फैसला दिया है कि रामायण या कुरान जैसे धर्मग्रंथों के नामों पर कोई भी व्यक्ति अपना दावा और उन्हें वस्तुओं व सेवाओं की बिक्री के लिए ट्रेडमार्क के तौर पर इस्तेमाल नहीं कर सकता है।
न्यायमूर्ति रंजन गोगोई और न्यायमूर्ति आरके अग्रवाल की पीठ ने कहा, कुरान, बाइबिल, गुरु ग्रंथ साहिब, रामायण आदि जैसे कई पवित्र एवं धार्मिक ग्रंथ हैं। यदि कोई पूछे कि क्या कोई व्यक्ति वस्तुओं या सेवाओं की बिक्री के लिए किसी धर्मग्रंथ के नाम का ट्रेडमार्क के तौर पर इस्तेमाल कर सकता है तो इसका जवाब है ‘नहीं’।
पीठ ने यह भी कहा कि ईश्वर या धर्मग्रंथों के नाम का इस्तेमाल ट्रेडमार्क के तौर पर करने की अनुमति देने से ‘लोगों की भावनाएं’ आहत हो सकती हैं।
उच्चतम न्यायालय का यह फैसला बिहार स्थित लाल बाबू प्रियदर्शी की एक अपील पर आया है जिन्होंने ‘रामायण’ शब्द का ट्रेडमार्क अगरबत्ती व इत्र बेचने के लिए मांगा था। बौद्धिक संपदा अपीलीय बोर्ड ने अपीलकर्ता के खिलाफ आदेश दिया था जिसको उसने न्यायालय में चुनौती दी थी।
शीर्ष अदालत ने अपने 16 पन्ने के फैसले में कहा, रामायण शब्द महर्षि वाल्मिकी द्वारा लिखित एक ग्रंथ का नाम है और इसे हमारे देश में हिन्दुओं का एक धार्मिक ग्रंथ माना जाता है। इसलिए किसी भी वस्तु के लिए रामायण शब्द का ट्रेडमार्क के तौर पर पंजीकरण कराने की अनुमति नहीं दी जा सकती है।
